Data Security and Privacy Plan

Introduction

At Teacher Created Materials, Inc. (“TCM”), we are committed to protecting the privacy and security of all personal information collected through our educational resources and platforms, including but not limited to the TCM Content Cloud and the TCM Learning Platform. This policy outlines our practices for collecting, using, storing, and protecting Personal Identifiable Information (“PII”), in compliance with applicable federal and state laws governing K–12 student and educator data.

Data Collection and Usage

Types of Data Collected

  • TCM Content Cloud: PII collected for the TCM Content Cloud is limited to teacher name, teacher email address, school name, and school address.
  • TCM Learning Platform: PII collected for the TCM Learning Platform is limited to the following:
    • Admin: name, email address, district name, and district mailing address
    • Teacher: name, email address or teacher ID, district and school name
    • Student: name, email address or student ID, district and school name, class, grade level

Data storage

  • TCM Content Cloud: PII (i.e., teacher name, teacher email address, school name, and school address) for the TCM Content Cloud is securely stored in an encrypted Amazon Web Services (“AWS”) database in accordance with NIST standards.
  • TCM Learning Platform: PII for the TCM Learning Platform is securely encrypted, transferred, and stored by our trusted provider, MagicBox, under strict data security protocols in accordance with NIST standards.

Data Usage

  • Educational Purposes Only: PII is used solely for educational purposes to enhance the learning experience and provide necessary support to students and educators. Non-PII data such as anonymized usage statistics, resource access frequency, and interaction metrics are used to improve TCM’s educational materials and services. TCM strictly prohibits the use of any PII for marketing purposes. We do not sell, trade, or otherwise share PII with third parties for marketing activities.
  • Cookies: Cookies are used only for authentication and usage analytics, never for targeted advertising or marketing. For the TCM Learning Platform, MagicBox’s cookie policy, click here.

Data Security Measures

Technical Safeguards

  • Encryption: All data transfers, especially PII, are encrypted using industry-standard protocols to prevent unauthorized access during transmission.
  • Access Control: Strict access control policies are in place. Only authorized personnel with necessary credentials can access PII stored with third-party providers for the TCM Content Cloud or the TCM Learning Platform.

Administrative and Organizational Safeguards

  • Audits: Annual cybersecurity audits are conducted to ensure ongoing effectiveness of controls in accordance with NIST standards.
  • Training: Employees with access to PII receive mandatory privacy and security training in accordance with NIST standards.
  • Data Retention: PII is retained only as long as necessary for educational purposes, legal compliance, or contractual obligations. Upon termination or district request, data is securely deleted in accordance with NIST standards.

Compliance

  • TCM complies with all relevant federal and state laws and regulations regarding data security and privacy, including the Family Educational Rights and Privacy Act (FERPA) and the Children's Online Privacy Protection Act (COPPA).
  • The TCM Learning Platform may be used by children under the age of 13 only under the direction and authorization of a school or district. We comply with COPPA by working directly with school authorities acting as agents for parental consent.

Third-Party Providers

  • TCM partners only with providers that meet or exceed applicable data security and privacy standards. These partners adhere to rigorous data security standards and comply with all relevant privacy laws. These sites have their own privacy policies and data collection, use and disclosure practices. Please consult each site's privacy policy.

User Rights and Controls

  • Access: Students, parents, and educators have the right to access the PII we hold about them. Requests can be made through customerservice@tcmpub.com.
  • Correction/Deletion: Schools and districts can request corrections or deletions of their PII if they believe it is inaccurate or no longer necessary for educational purposes. Data is retained only as long as necessary to provide services, fulfill contractual obligations, or comply with legal requirements. Upon termination or by district request, data is securely deleted.
  • Breach Notification: In the event of a data breach, TCM will notify affected parties and regulatory authorities in compliance with applicable laws and contractual obligations.

Policy Updates

TCM reserves the right to update this policy periodically to reflect changes in our practices, technology, legal requirements, and other factors. Any updates will be communicated to our users through appropriate channels.

California Privacy Rights Addendum (CCPA/CPRA Notice)

This section supplements the information contained in the Teacher Created Materials, Inc. (“TCM”) Data Security and Privacy Policy and applies solely to residents of the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA) and the California Privacy Rights Act of 2020 (CPRA) and other California privacy laws. Any terms defined in the CCPA/CPRA have the same meaning when used in this notice.

Categories of Personal Information We Collect

We collect the following categories of personal information:

  • Identifiers (e.g., name, email address, student ID, teacher ID)
  • Educational information (e.g., grade level, class, school/district affiliation)
  • Internet or network activity (e.g., platform usage analytics)
  • Geolocation data (e.g., school or district address)
  • In limited cases, sensitive personal information such as student or teacher IDs tied to specific educational use

We collect this information solely for educational purposes and never for targeted advertising or marketing.

How We Use Personal Information

We may use or disclose personal information for the following business purposes:

  • To provide, support, and improve our educational products and services
  • To fulfill contractual obligations with schools and districts
  • To comply with legal obligations and ensure platform security
  • To respond to lawful requests by public authorities

Consumer Privacy Rights

California residents have the following rights under the CCPA/CPRA:

  1. Right to Know and Access – You may request disclosure of the categories and specific pieces of personal information we have collected about you.
  2. Right to Delete – You may request deletion of personal information we have collected from you, subject to legal and contractual exceptions.
  3. Right to Correct – You may request correction of inaccurate personal information.
  4. Right to Opt-Out of Sale/Sharing – We do not sell or share your personal information. If this ever changes, you will be provided with a “Do Not Sell or Share My Personal Information” link.
  5. Right to Limit Use of Sensitive Personal Information – You may request that we limit the use of sensitive personal information (such as student or teacher IDs) to only those purposes necessary to provide educational services.
  6. Right to Non-Discrimination – You have the right not to receive discriminatory treatment for exercising any of your privacy rights.

We will respond to verifiable consumer requests within the timeframes required by law (generally 45 days, with a possible 45-day extension).

Authorized Agents

You may authorize another person to make a privacy rights request on your behalf. We may require verification of your identity and the agent’s authorization.

Policy Updates

We may update this Addendum from time to time. When we make changes, we will revise the “Effective Date” and notify you through appropriate channels.
